Govt asked to produce Ershad in court or release himNew Age Online
Jatiya Party’s organising secretary Bokhtiar Uddin Khan Iqbal on Tuesday served a legal notice to the government asking the Hasina-administration to produce the JP party chairman HM Ershad before the court or release him immediately.
The notice has been sent to home secretary and its deputy secretary (police) by senior Supreme Court lawyer Rafique-ul Huq, on behalf of his client, and stated that the Rapid Action Battalion arrested or detained Ershad after nabbing him from his President Park residence at Baridhara in the capital at around midnight on December 12. He was then forcibly taken to the Combined Military Hospital by a blue coloured microbus of RAB-1.
‘It was claimed by RAB-1 that they had taken him to CMH since he was seriously ill. This is completely false statement since Ershad is a physically fit person,’ reads the notice.
It said that Ershad had purportedly been detained by law enforcement agency ‘without maintaining any legal process’.
'You are requested to release HM Ershad immediately or produce him before the High Court' so that it may satisfy the court that he is not being held in custody illegally or in unlawful manner, said the notice.
Otherwise, the notice warned, ‘We have clear instructions from our client to file an application before the High Court to protect fundamental rights of former president HM Ershad.’
