Former Bangladesh Cricket Board president Saber Hossain Chowdhury backed out from the forthcoming election on the pretext of contempt of court fear saying that if he had participated he could have easily been charged.
The Appellate Division of the Supreme Court on July 25 allowed the BCB to hold its executive body election after a legal battle over the constitution had stalled it for months.
The court order says: ‘The ensuing election of the BCB is to be held as per the amendment of its constitution made on 21st November, 2012 by the NSC subject to the result of the appeal.’
‘I have decided not to be a part of the forthcoming BCB election as it seemed to be contempt of court,’ Saber told reporters at a press conference.
‘The whole process that is followed by the NSC cannot be legalised as per the Supreme Court order issued in this regard,’ said Saber.
Saber, along with organisers of the Divisional and District Sports Associations, called the impromptu press conference to clear their position over the election that they alleged is pre-designed to favour their rival group, led by incumbent BCB president Nazmul Hasan.
Saber’s decision came hours after his rival group members bought their nomination papers for the October 10 election.
The decision of Saber was unsurprising after the election commission had rejected all 16 allegations against councillorship made by his group.
The commission, however, did Saber a favour providing him the certified copy of the Supreme Court order as requested by him. Saber presented the copy in the press conference before calling it quits from the race.
‘The election schedule was announced before they received the true copy of the court order. It certainly proved the [NSC] did not follow the court order,’ alleged Saber.
The NSC had earlier served the schedule of the BCB election on October 26 whereas the true copy of the court order received by the sports regulatory body was dated on October 30.
Saber’s decision apparently provides an easy ride to his opposition though they are unlikely to get a bye as 43 candidates have bought nomination papers for 23 directorial posts from three categories.
The election in category-3 becomes the new highlight after three nomination papers were sold against one post. The candidates in this category include two former national skippers - Gazi Ashraf Hossain and Khaled Mahmud - both closely linked to Nazmul.
Ashraf, the current ad-hoc member won from category-3 in the last election but Mahmud, who was also a part of this committee before resigning, decided to try his luck.
