SC upholds HC order to freeze Suranjit’s APS accountNew Age Online
The Appellate Division on Tuesday rejected a petition filed by Omar Faruq Talukder, former personal secretary of minister without portfolio Suranjit Sengupta, for staying a High Court order that had ordered freezing Faruq’s bank account.
The Appellate Division’s vacation judge, Justice MA Wahhab Miah passed the order following a petition filed by Faruq for staying the High Court’s order issued on July 29.
The High Court upheld a lower court’s order on May 9 that had not allowed Faruq to operate his bank account at Mercantile Bank’s Dilkhusha branch where Tk 74 lakh were reportedly deposited. The amount was seized from a micro-bus heading to Suranjit’s house at Jhigatala in the capital.
The High Court gave the order after hearing a writ petition filed by the Anti Corruption Commission challenging the legality of the lower court order keeping Faruq’s bank account operational.
On April 9 last year, the then Railways Minister Suranjit’s APS Faruq was caught red-handed by members of Border Guard Bangladesh with TK 74 lakh, money allegedly received as bribe, while he was going to Suranjit’s Jigatala residence on a motor vehicle.
The Anti-Corruption Commission filed a case against APS Faruq, and the court ordered freeze on his bank account with the Dilkhusha branch of Mercantile Bank.
Later, the lower court in an order reopened his bank account prompting the ACC to move to the higher court, seeking a remedy against the court order.
Advocate Khurshid Alam Khan appeared for the ACC while advocate ASM Shahjahan stood for Faruq.
