Bangladesh Jamaat-e-Islam on August 1 appealed with the Appellate Division immediately after a High Court verdict declared illegal the Election Commission’s decision of registering Jamaat-e –Islam as a political party.
Jamaat’s acting secretary general Mohammad Rafiqul Islam filed the appeal seeking stay on the operation of the High Court verdict.
Petitioner’s lawyer Abdur Razzaq told reporters that he had gone to the chamber of the Appellate Division’s judge, Justice Syed Mahmud Hossain, but he refused to hear the appeal as court hours were over.
A special bench of Justice M Moazzam Husain, Justice M Enayetur Rahim and Justice Quazi Reza-ul Hoque delivered the verdict declaring illegal Jamaat’s registration as political party.
The same bench on June 12, after completion of the hearing on the writ petitions, had reserved the pronouncement of the judgment for a later date.
The Bangladesh Tariqat Federation secretary general, Syed Rezaul Haque Chandpuri, and 24 leaders of the federation, Zaker Party and Sammilita Islami Jote had filed the writ petitions on January 25, 2009.
After a preliminary hearing on the writ petitions, a High Court bench had issued a rule on January 27, 2009 asking the EC and Jamaat to explain why the commission’s decision on November 20, 2008 to register Jamaat as a political party would not be declared illegal.
